FINAL EXAMINATION: LAW ON OBLIGATIONS AND CONTRACTS

I. CASE 1 - A two-year-old child fell on an old water well.

(1) Are the parents liable for negligence resulting to death of their 2-year-old child? Please provide your legal opinion with legal basis.

(2) Is the owner of an old well also liable for negligence resulting to death of a 2-year-old child? Please provide your legal opinion with legal basis.



II. CASE 2 - A 7-year-old girl died due to Jellyfish sting at Camarines Sur Resort

(1) Is the Camarines Sur Resort liable for both civil and criminal offenses for any negligence that resulted to death of a 7-year-old child?  Please provide your legal opinion with legal basis.

(2) Is the Camarines Sur Resort liable to pay damages to the family of the victim? What are the types of damages that the family of the victim can claim?



III. CASE 3 - Group of students hit by a raging jeep

(1) What level of standard of care should the Jeepney driver exercise when driving?

(2) Was the jeepney driver committed a negligence on the fulfillment of his obligation?  If yes, was it an ordinary negligence or gross negligence?

(3) Is the jeepney driver liable for a criminal offense that resulted to physical harm of students?



IV. CASE 4 - Fake Rice


(1) Is the supplier (obligor) committed a fraud at the beginning of their contract when delivering fake rice? 

(2) If the delivered rice was found to be "fake", will the obligor liable to pay damages to the obligee? What are the other legal remedies of obligee-creditor in this issue?

(3) Will the contract of sale still valid if the object of the contract is found to be fake?
